Terms of Use

These Terms of Use (“Terms”) govern your access to and use of HealthCoach (the “App”) and related services provided by Teknical Solutionz LLC (“we”, “our”, or “us”). By using the App, you agree to these Terms.

1. Description of Service

HealthCoach provides wearable integrations, unified health data views, and AI-assisted insights and guidance (including suggested workout plans and ongoing analysis). The App is for informational and educational purposes only.

2. Eligibility

You must be at least 13 years of age to use HealthCoach. If you are under 18, you must have permission from a parent or legal guardian. By using the app, you represent that you meet these requirements.

3. Medical Disclaimer

HealthCoach is a wellness and self-tracking tool for educational and informational purposes only. It is not a medical device and has not been evaluated or approved by the FDA or any regulatory body. The app does not provide medical advice, diagnosis, or treatment. Biomarker reference ranges, wellness insights, AI-generated health plans, goal suggestions, and all other content are for informational purposes only and should not be used as a substitute for professional medical advice. Always consult a qualified healthcare professional before making changes to your diet, exercise, supplement, or medication regimen. If you are experiencing a medical emergency, call your local emergency services immediately.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

5. Acceptable Use

You agree not to misuse the App, attempt unauthorized access, reverse engineer, scrape data, or disrupt service functionality.

6. Subscriptions and Payments

HealthCoach may offer subscription plans through the Apple App Store or Google Play Store. Payment is processed by Apple or Google, not directly by Teknical Solutionz LLC. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's App Store or Google Play settings. Refunds are subject to Apple's or Google's refund policies. We do not directly collect or store your payment information.

7. Third-Party Integrations

The App may integrate with third-party platforms (for example, Oura, Apple HealthKit, and other wearable providers). When you connect an integration, you authorize access only to the data you approve, and you may revoke access at any time. Third-party services are governed by their own terms and privacy policies.

8. Intellectual Property

All content, features, and functionality of HealthCoach — including but not limited to text, graphics, logos, icons, software, and AI-generated content — are the property of Teknical Solutionz LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the app without our prior written consent.

9. Disclaimer of Warranties

HealthCoach is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. Health-related information displayed in the app is for educational and informational purposes only and may not be accurate, complete, or current. We make no representations regarding the accuracy or reliability of any health insights, biomarker reference ranges, AI-generated content, or wellness suggestions provided through the app.

10. Limitation of Liability

To the fullest extent permitted by law, Teknical Solutionz LLC is not liable for any health outcomes, data inaccuracies, or third-party service interruptions arising from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Teknical Solutionz LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of HealthCoach, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to HealthCoach at any time, with or without cause or notice. You may stop using the app at any time. Upon termination, your right to use the app ceases immediately. You may request deletion of your data at any time, regardless of account status. Sections that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, and Indemnification) will survive.

13. Data Deletion

You may delete your account and associated data at any time using the in-app “Delete All Data” feature, or by contacting us.

14. Dispute Resolution

Any dispute arising from these Terms or your use of HealthCoach shall first be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be resolved through binding arbitration in the State of Michigan in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

15. Governing Law

These Terms are governed by the laws of the State of Michigan, United States.

16. Apple App Store Terms

These Terms are between you and Teknical Solutionz LLC only, and not with Apple Inc. Teknical Solutionz LLC, not Apple, is solely responsible for the HealthCoach app and its content. Your use of HealthCoach must comply with the App Store Terms of Service. Apple has no obligation to provide maintenance or support for HealthCoach. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to HealthCoach. Apple is not responsible for addressing any claims by you or a third party relating to HealthCoach, including product liability claims, any claim that HealthCoach fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection or similar legislation. In the event of any third-party intellectual property claim, Teknical Solutionz LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
